Publication of the monograph The Failures of Others: Justifying Institutional Expansion in Comparative Public and International Law.
The monograph examines how institutions justify the expansion of their competences by invoking the failures of other institutions. It analyses “arguments from failure” as a distinct concept of public law across different contexts of national, European and international law. The book thereby provides a normative framework for assessing such arguments on the basis of the principles of separation of powers, democracy and the rule of law.
A book symposium on the monograph has also been published on the blog of the American Society of Comparative Law.
